Terms and Conditions
Buyer: Person who places the order and is 18 years of age or older
Order: An order placed by the buyer in accordance with the description in article for the delivery of one or more items.
Purchase price: The price indicated on the website for a product, includes VAT and delivery shipping costs. (Note; return cost and local tax and costs for customs are for the buyer).
Agreement: Order, which the seller has accepted as such.
ARTICLE 1: APPLICABILITY OF THE GENERAL TERMS AND CONDITIONS
The general terms & conditions that have been made available online by the seller on www.carmengomezymaseland.com
Govern all offers, agreements, orders and other legal relationships between the buyer and seller with respect to the use of the website, including the purchase and sale of a product on or via the website.
ARTICLE 2: CONCLUSION AND CONTENT OF AGREEMENT
2.1The buyer and seller exclusively by means of the seller acceptance will conclude an agreement of an order from the buyer that has been placed on the website in the following manner:
- Buyer has selected the product in the desired style, size and color and has added the product to the shopping cart.
- Buyer has followed and completed the following steps:
- Buyer filled in her address details and if the delivery address is not the same, the desired delivery address
- Buyer has checked her order
- Buyer has selected the desired payment method and made a full advance payment
- Buyer accepted the terms & conditions
- The order has been placed
- Buyer will receive a confirmation of the order that has been placed on the website
- If the order has been accepted by the seller, the seller will send the buyer a confirmation by email as soon after the order has been placed
The seller will be entitled to reject an order placed by the buyer at her own decisions but at least in the following cases:
- If the buyer’s payment is not received according the agreement
- If the buyer has filled in his information incorrect and or incomplete, or if the seller is reasonably entitled to doubt whether that is the case
- If the buyer has already failed to comply with her payments obligations towards the seller in the past
- If the buyer has failed to accept orders in the past that she placed with the seller, the seller will inform the buyer as soon as possible if the order cannot be accepted
ARTICLE 3: DELIVERY METHOD AND DELIVERY DATES
Shipment will be made using a carrier designated by the seller
After the agreement has been concluded the seller will send the products as quickly as possible to the address as indicated by the buyer, provided that the seller has received the full purchase price.
The seller will make the delivery in best effort. Insofar the seller is dependent on the work and services provided by third parties and information provided by the third parties.
The risk with respect to any damage to or loss of the products will be transferred to the buyer as from the time at which the products are delivered.
ARTICLE 4: PAYMENT AND PRICING
The prices on the website are indicated in Euro’s, are inclusive of added tax (VAT) and including the delivery shipping costs for European countries excluding Malta and Cyprus. Countries outside Europe, selected by seller, an additional fee will be charged. Countries not selected by seller, please contact firstname.lastname@example.org. The return shipping costs will be borne by the buyer.
The seller will be entitled to adjust the prices indicated on the website from time to time without any notice being required. The prices indicated at the time at which the order is placed and confirmed will be deemed to be the price that will form part of the agreement.
The payment must be made by using one of the methods mentioned on the website and must be made during confirmation of the order.
In the event that the buyer does not fulfills the payment conditions, the seller is entitled to stop the order.
If buyer does not want to adopt the delivered package, all costs will be charged to buyer, includes the bought product, all shipment costs, taxes and customs expenses.
ARTICLE 5: RIGHT TO RETURN
The buyer will be entitled to return the product that has been delivered, on cost of buyer, and within a term of 14 days after the product has been received. The product must not been worn, is undamaged and is in the original condition and undamaged packing. The buyer will not be permitted to exchange the product for another product. If the buyer wishes to purchase another product, he or she will have to place a new order on the website.
In the case referred to in the preceding section 5.1, the seller will refund the purchase price as quickly as possible after receiving of the returned product(s).
Late or missing refunds:
If you haven’t received a refund yet, please first check your bank account. Next contact your bank or Credit Card Company. It may take some time before refund is officially posted. If you’ve done all of this and you still have not received your refund, please contact us at email@example.com
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.
To return your product, you should send your product to: Leeghwaterstraat 32, Middenbeemster 1462 JE, The Netherlands. Buyer will be responsible for paying your own shipping costs for returning your item. Shipping costs are non-refundable.
ARTICLE: FORCE MAJEURE
6.1Seller is not liable for any damage as a result of a delay in the delivery or a failure to deliver that has been caused by circumstances that impede the seller from complying with its obligations and that cannot be attributed to the seller because they cannot be blamed on the seller and cannot be deemed to be for the seller’s account in accordance with the law, a legal act or in accordance with generally accepted standards such, but not restricted to, war, threat of war, riots, strikes, transport problems, trade limitations, problem with customs authorities, fire, flooding, earthquake or the bankruptcy of a third parties engaged by the seller.
ARTICLE 7: COMPLAINTS
7.1Buyer will be obliged to inspect product when it has been delivered and to notify the seller within a reasonable term in the event that there are any visible defects regarding the performance of the agreement. Such complaints must be submitted in writing per e-mail and must be fully and clearly substantiated. Mail to firstname.lastname@example.org
Seller will respond to any complaint that it receives within the tern of 14 days after receipt.
Buyer acknowledges that minor deviations and deviations that are generally considered acceptable in respect of the quality, size, finishing, color etc. of products, cannot be avoided or are to avoid and do not constitute a well-founded reason to submit a complaint. Such complaints and complaints regarding the removal of certain products from the website are not well founded. Seller will not be liable for any damage that the buyer sustains as a result of such deviations or the removal of such products from the website.
ARTICLE 8: GUARANTEE AND LIABILITY
Seller is required by law to provide a product that meets the agreement with the buyer.
Seller is not liable for any indirect, additional or consequential damage, of any kind whatsoever that the buyer sustains in connection with the agreement.
Products are exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our return policy. We have made every effort to display as accurately as possible the colors and images of our products that appear on the website. We cannot guarantee that your computer monitor’s display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case by case basis. We reserve the right to limit the quantities of any products or services that we offer.
Remote area locations:
Some countries or regions who are difficult to reach by the courier, additional costs will be charged to the buyer. Buyer will be informed in advance by mail.

Carmen Gomez y Maseland offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

10.1When buyer purchase items from our webshop, as part of the buying and selling process, we collect the personal information you give to us as such as your name, address and email address.
With your permission, we may send you emails about the website for new products and other updates.
